Terms and Conditions for BladeSync

These Terms and Conditions ("Terms") govern your access to and use of BladeSync ("we," "us," or "our"), the mobile application and related services (collectively, the "Service"). BladeSync is a companion application for players of the game "Switchblade" (published by Lucid Games; official website: https://www.switchbladegame.com/). Switchblade and its trademarks, content, and rules are owned by their respective rights holders; we are not affiliated with or endorsed by Lucid Games except as a community companion tool.

By creating an account, downloading or using the Service, or continuing to use the Service after we post changes to these Terms, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility and Accounts

• You must be able to form a binding contract in your jurisdiction and meet any minimum age required by applicable law (including at least 13 years of age where the Children’s Online Privacy Protection Act or similar rules apply).
• You are responsible for the accuracy of information you provide and for keeping your credentials secure. You are responsible for all activity under your account unless you notify us promptly of unauthorized use.
• We may refuse registration, suspend, or terminate accounts that violate these Terms or pose risk to the Service or other users.

2. License to Use the Service

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use. You may not copy, modify, distribute, sell, lease, or reverse engineer the Service except as allowed by applicable law.

3. Acceptable Use

You agree not to:

• Use the Service in violation of law or third-party rights, or to harass, abuse, defraud, or harm others.
• Attempt to gain unauthorized access to the Service, other users’ accounts, or our or our vendors’ systems.
• Interfere with or disrupt the Service, including by introducing malware, excessive load, or automated scraping not expressly permitted.
• Use the Service to cheat, exploit, or circumvent rules of Switchblade or any platform’s terms of service.
• Post unlawful, infringing, or excessively offensive content through community or support channels.

We may remove content, restrict features, or terminate access for conduct we reasonably believe violates these rules or harms the Service or community.

4. User Content

If you submit messages, event details, profile information, or other content ("User Content") through the Service, you retain ownership of your User Content. You grant us a worldwide, non-exclusive license to host, store, reproduce, and display User Content solely as needed to operate, improve, and secure the Service. You represent that you have the rights to grant this license and that your User Content does not violate law or third-party rights.

5. Third-Party Services

The Service relies on infrastructure and tools provided by others (for example, Supabase for backend features and OpenRouter for translation-related features). Your use of those services may be subject to their terms and policies. We are not responsible for third-party services or websites linked from the Service.

6. AI and Translation Features

Features that use artificial intelligence or machine translation may produce inaccurate or inappropriate output. You are responsible for how you rely on or share such output. We do not warrant that translations or AI-assisted features will be error-free or suitable for any particular purpose.

7. Intellectual Property

The Service, including its design, branding, and software (excluding User Content and third-party materials), is owned by us or our licensors. Switchblade-related names, imagery, and game content remain the property of their respective owners. Nothing in these Terms grants you rights to Lucid Games’ or Switchblade’s intellectual property.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

9. Limitation of Liability

To the fullest extent permitted by law, we and our affiliates, officers, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for claims arising from the Service is limited to the greater of (a) the amount you paid us for the Service in the twelve months before the claim or (b) fifty U.S. dollars (USD $50), except where such limitations are prohibited by law.

10. Indemnity

You will defend and indemnify us against claims, damages, and expenses (including reasonable attorneys’ fees) arising from your User Content, your misuse of the Service, or your violation of these Terms or applicable law.

11. Termination

You may stop using the Service at any time. We may suspend or terminate your access with or without notice for conduct that we believe violates these Terms or is harmful to the Service, users, or third parties. Provisions that by their nature should survive (including licenses for User Content as needed to wind down, disclaimers, limitations of liability, and indemnity) will survive termination.

12. Changes to the Service and These Terms

We may modify or discontinue features of the Service. We may update these Terms by posting a revised version in the Service or at this URL. Material changes may be communicated through the Service or by email where appropriate. Continued use after the effective date of changes constitutes acceptance unless applicable law requires your separate consent.

13. General

• Entire agreement: These Terms are the entire agreement between you and us regarding the Service and supersede prior understandings on this subject.
• Severability: If any provision is unenforceable, the remainder remains in effect.
• No waiver: Our failure to enforce a provision is not a waiver of our rights.
• Assignment: You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.

Governing law and venue depend on where you live and applicable rules; if you are a consumer, mandatory consumer protections in your country may apply notwithstanding any choice of law in these Terms.
